Aery Aviation Announces FAA Withdrawal of Entire Proposed $15.7 Million Civil Penalty

No finding of violation and no civil penalty assessed in the matter; Aery reaffirms its position and continued commitment to safe, compliant aviation operations

NEWPORT NEWS, VA, UNITED STATES, September 29, 2026 /EINPresswire.com/ — Aery Aviation, LLC announced today that the Federal Aviation Administration has withdrawn in its entirety the civil penalty letter, FAA Case No. 20235O110001, issued to the company on December 22, 2025. The proposed civil penalty totaled approximately $15.7 million. No portion of that proposed civil penalty will be assessed in this matter; there has been no finding of violation and the matter is closed.

In its formal notice, the FAA stated: “After full consideration of the above-referenced case and the evidence presented, we have determined that it is not in the interest of justice to pursue this particular matter. The civil penalty letter issued December 22, 2025, is therefore, hereby withdrawn.”
Aery contested the proposed action from the beginning and maintained throughout the administrative process that it did nothing wrong and that the proposed penalty was not supported by the facts and law applicable to the operations at issue. Aery presented documentary evidence through the FAA’s administrative process addressing the factual, aircraft, operational, and jurisdictional issues raised in the proposed action.

“The result is clear: the proposed $15.7 million civil penalty has been withdrawn in full.
